The First District Court of Appeal affirmed an award of sanctions against Mother in a domestic violence and custody action, led by Ms. Lewellen and co-counsel, criminal defense attorney, Charles Smith, Jr., representing Father. Ms. Lewellen and Mr. Chuck Smith tried the mutual “DV” case and Father was fully exonerated of Mother’s accusations of “DV”. Father was awarded sole legal and physical custody of the minor child. Domestic violence restraining orders were entered against Mother. Ms. Lewellen advocated for $222,952.33 in sanctions against Mother for false allegations of domestic violence and child neglect, as well as violating Fam Code section 271 mandates. The trial court awarded $222,942.33 to Father and Mother appealed. In a decision addressing the reasonableness of the award and Mother’s alleged inability to pay, the Appellate Court affirmed the trial court.
